What’s Required for Businesses with ACA
If an employer has 50 or more full-time equivalent (FTE) employees, ACA requires the company to provide an affordable healthcare coverage option to at least 95% of the eligible employees. This coverage must also cover their dependents and be affordable according to IRS-approved calculations.

Calculating If Your Company is an Applicable Large Employer for ACA Requirements
An applicable large employer (ALE) is a company that has an average of 50 full-time or full-time equivalent employees. Under the ACA, employees are considered full-time if they work over 30 hours a week. Employees are considered full-time equivalent if a group of two or more employees works 30 hours a week. For example, if a company has three employees that work 10 hours a week, they would equal 1 FTE employee.
To calculate if your company has 50 or more FTE employees, you must take the average number of employees on staff during the previous year. So, while your company may only have 46 employees at the time of calculation, if your company averaged 50 or more during the previous year, you must follow the ACA requirements.

- Deadline to file Forms 1094-C and 1095-C if filing electronically: March 31, 2023
- Deadline to file Forms 1094-C and 1095-C if filing by paper: February 28, 2023
- Deadline to distribute forms 1095-B and 1095-C to employees: March 31, 2023
